What is a Section 32 (Vendor’s Statement’)

When you’re in the process of buying a property in Victoria, Australia, you’ll often come across a set of documents that are crucial for making an informed decision. One of these documents is a Section 32 (or ‘Vendor’s Statement’), attached to the Contract of Sale. This is a mandatory legal document, which is required for all property contracts under s32 of the Sale of Land Act 1962 (Vic). A Section 32 provides important disclosure to potential buyers. 







A Section 32 is composed of several documents, including:

– Register Search Statement: This section includes a summary of the property’s history, including any previous sales, mortgages, and easements.

– Plan of Subdivision: This document outline’s the property’s boundaries, along with any easements, covenants or restrictions on the land. 

– Services: This section includes information about the services that are available to the property, such as water, sewer, gas, and electricity.

– Planning Information:  Including information about the zoning of the property and any applicable planning restrictions.

– Certificates from Relevant Authorities:  these include notices from the Council, Water Authority, VicRoads, the State Revenue Office, and the Owner’s Corporation (if applicable). 

– Building Permits: Information about any building permits issued under the Building Act 1993 (VIC) in the preceding six years is included. It may also contain occupancy permits, final inspections, defects reports, or insurance details if necessary. 

– Due Diligence Checklist: This section is a checklist that the buyer can use to ensure that they have received all of the necessary information about the property.

As Section 32 Statements can be long, often spanning close to 100 pages, it is important to seek professional advice from a conveyancer or solicitor. It is important to get professional advice before you buy, as it can be difficult and expensive to get out of a property contract.
